ANSONIA — On an unseasonably warm April morning, the gardeners are hard at work, tending to vegetables and herbs.

They are growing strawberries and blueberries, carrots, peas, lettuce and garlic in the Ansonia Community Organic Gardens on Milan Street. Two men have brought their dogs to the garden, and they are sitting in the sunshine, keeping a watchful eye.

Joe Tamburrino of Seymour is putting down stones to create a small patio. He imagines it to be a tranquil spot to rest, with a bench, fountain and statue of the Virgin Mary.

But when Louis Mazerolle of 22 Milan St. looks out his window at the gardens, he sees something different: trash.

He’s taken photos of what he views as eyesores in the gardens: plastic orange fencing, plastic buckets, lawn chairs, tarps, garbage bags, a rusty stove. He said the gardeners also drive their vehicles on the adjacent wetlands and throw their trash back there.

“The garden’s been here for 40 years. I’ve never complained about the garden until these people took over,” Mazerolle said.

Last fall, he said, the gardeners began showing up around 8:30 at night, and staying until near midnight. Mazerolle said he called the city to complain, and police officers were sent out.

Now, Robert Natusch of Seymour, a gardener, said police often come to the garden at sunset, when it’s supposed to close, and say, “Go home,” with threats of arrest. He said he was questioned by police five times last year “about nothing. About why I was standing here in my garden.”

Ansonia police Lt. Andrew Cota said officers check all city parks at night to make sure they’re closed and no one is inside.

Then, a few months ago, Mazerolle went to see Mayor James Della Volpe about the trash in the garden. He also spoke to Superintendent of Public Works Michael Stryver. Not much was done until recently, when Mazerolle spoke to acting Mayor Steve Blume, who said he’d take care of the problems.

Recently, the gardeners were ordered to remove several chickens that were living at the garden, and take down the coops. They also had to take down a greenhouse they’d constructed.

City officials say they will soon hold a meeting with the gardeners to update their bylaws, which are about 35 years old, to try to address the problem behavior.

The Ansonia Community Organic Gardeners is a nonprofit group that’s been in existence since the 1970s. According to President Pat Evans, it has experienced a revival in recent years, with the membership doubling each of the past two. But their plots now stretch into view of Mazerolle’s house, which Evans said is what’s causing him to complain now.

The gardeners say they’re trying to be good neighbors and comply with all the city’s demands. But they feel unfairly persecuted, and wonder why the city always sides with the one neighbor who complains, versus the 20 or so gardeners.

“We’re being put under a microscope,” said Evans. “It’s really nothing terribly bad going on that they have to spend so much energy and focus on these little concerns.”

The gardeners said Mazerolle has told them he wants them out of there, and won’t be satisfied with any improvements they make.

But Mazerolle insisted, “I’m not against the garden. I don’t want them out of here. I want it the way it used to be. I want it clean. I don’t want it to look like a dump.”

He said other neighbors, who don’t speak up, feel similarly.

Steven Schumacher, past president of the gardeners from the late 1980s until 2000 and a neighbor of the garden, said when he was in charge, they gardened from the second week of April to the killing frost in the fall. Then, “everything got cleaned up.” He said now the gardeners seem to come year-round, and never remove their stuff. This winter, “that looked like the city dump,” he said.

The gardeners say they’ve taken steps to clean up the land. They’ve removed rugs, fences and other garbage thrown on the adjacent wetlands. Evans said he plans to ban plastic from the gardens, and remove unsightly tarps and neon orange plastic fencing. He’s thinking of erecting a wooden privacy fence between the gardens and Mazerolle’s property.

However, the gardeners proudly reuse abandoned objects as planters and ornaments in the garden.

Tamburrino was given three days by city officials to remove his chickens and take down the coops. He found a new home for them at Schreiber’s Farm in Oxford, but says he misses them. They were his pets: Abigail, Mary Jane, Melissa, Bubba and KD. He said the chicken coops he had constructed were very well ventilated, free of odor and disease.

Moreover, Natusch explained, “The chickens were important for the biodiversity cycle that they were basically showing, which is that they eat the bugs, they produce manure, they produce mulch, they produce eggs. And those four fit into a balanced cycle with the rest of the garden. And, plus a big part of the garden is kids, and next to the little rabbit over there, the chickens were the biggest draw for the children. We try to get the kids up here interested in the garden, and bring them in with the animals first, and then they get into the plants and then they don’t go away.”

Natusch believes the gardeners had a legal right to have chickens on the land, since it’s zoned as farmland. But Tamburrino quickly agreed to remove them so as to not cause trouble. Tamburrino also disassembled the greenhouse, though he believed it was legitimate since it was not a permanent structure and didn’t require a permit.

“Essentially, we’re out to be good neighbors. We don’t want to upset anyone,” said Tom Noble of Ansonia, vice president of the gardeners.

Tamburrino added, “We’re not here to cause trouble. … What do they think we do up here?”

Everyone involved hope their issues will be resolved with the meeting on the gardeners’ bylaws.

Donna Lindgren, director of the Ansonia Nature & Recreation Center, of which the garden is a part, said, “I’m certainly confident that it’s all going to be settled amicably to everyone’s satisfaction. We want the city to organize their bylaws with them and come up with something that’s workable that they can live by and still be happy gardening down there. We want them to stay, obviously. It’s a good use of the land.”

Still, Schumacher worried, “When they come up with the new bylaws, who’s going to enforce it? … The town has no control over it.”
